These Terms and Conditions ("Terms") govern your use of the website uplightmiami.com (the "Site"), operated by UPLIGHTMIAMI LLC ("Uplight Miami," "we," "us," or "our"). By accessing or using the Site, requesting a quote, or booking services, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Our Services
Uplight Miami provides event lighting, audio/visual equipment, presentation equipment, staging, and rigging rental services, including delivery, setup, and breakdown, within our South Florida service area. Availability, pricing, and delivery radius are subject to change and confirmation at the time of booking.
2. Quotes and Bookings
Quote requests submitted through the Site are not confirmed bookings. A booking is only confirmed once you complete the reservation and any required deposit through our booking platform, and you receive written confirmation from us. Package pricing shown on the Site is a starting point and may vary based on event date, location, and specific requirements.
3. Payment
Payment terms, deposits, and cancellation timelines are set out in your individual rental agreement and booking confirmation at the time of reservation. Invoicing is managed through our accounting systems and is separate from these Site Terms.
4. Rental Agreement Governs Your Event
Your use of this Site does not itself create a rental contract. All equipment rentals are subject to a separate rental agreement, provided and signed at the time of booking, which governs equipment use, damage and loss liability, delivery windows, setup and breakdown responsibilities, and cancellation terms. In the event of any conflict between these Terms and your signed rental agreement, the rental agreement controls for matters related to your specific event.
5. Site Content
All content on this Site, including text, images, logos, and design, is the property of Uplight Miami or its licensors and may not be copied, reproduced, or used without our written permission.
6. Acceptable Use
You agree not to use the Site to submit false or fraudulent booking requests, interfere with the Site's operation or security, or misuse any content or information obtained from the Site.
7. Third-Party Services
Bookings and payments may be processed through third-party platforms. Your use of those platforms is also subject to their own terms and privacy policies, in addition to ours.
8. Disclaimer of Warranties
The Site is provided "as is." While we make reasonable efforts to keep information accurate and current, we do not guarantee that all content, pricing, or availability shown on the Site is error-free or up to date at all times.
9. Limitation of Liability
To the extent permitted by law, Uplight Miami is not liable for indirect, incidental, or consequential damages arising from your use of the Site. Liability related to equipment rental, delivery, or use at your event is governed separately by your signed rental agreement.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of Miami-Dade County, Florida.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
